how to manage risks associated with conflicts or dilemmas between an individual’s rights and the duty of care

Take for example, a service user refused to take the medication prescribed by the doctor.

I will try to encourage the service user to take the medication by explaining the positive health implications it will have on him/her if they take it, and also the possible consequences if they refused to have the medication. I could also ask a more experienced staff member to explain to them. Finally I will record refusal/acceptance on the person’s support plan.

Take for instance there is no smoking policy in a care home but one of the service user is smoking in their room.

I would explain the possible danger of smoking in the room to both the person’s health and to others in the care home. I would then offer alternative smoking locations to the person such as smoking in the garden. However, if the person insists on smoking, check with the manager, and ask them to discuss this with the individual.
